TAKEOVER Privacy Policy

1. Scope and Who We Are

This Privacy Policy explains how Aria Technologies Inc. ("Aria", "we", "us", or "our") handles personal information when you use Takeover, including the mobile application, beta versions, related websites, and services that link to this Policy. Takeover is operated by a Canadian company and may be made available to users in Canada and the United States. Privacy rights and obligations may vary depending on where you live and which laws apply to Aria's activities.

2. Information We May Collect

Depending on the features you use, Takeover may collect information you provide directly and information generated through your use of the service, including:

3. How We Use Information

We may use personal information to provide and operate Takeover; create and secure accounts; provide vehicle, social, Crew, community, event, convoy, navigation, route, Sanctuary, and other location-dependent features; personalize and improve the service; measure feature usage; diagnose crashes and errors; prevent fraud and abuse; moderate content; enforce our Terms and Community Guidelines; communicate with users; comply with legal obligations; respond to lawful requests; and protect users, Aria, and the public.

4. Location Information

Takeover may request access to location information for features such as navigation, live convoy coordination, Crew or Sanctuary functionality, nearby or event-related functionality, routes, and other location-dependent services. Depending on the feature and the permissions you grant, location information may be precise or approximate and may be processed in real time or near real time.

Takeover will use device and in-app permission controls appropriate to the feature. Enabling device-level location permission does not by itself mean that every Takeover feature may use or share your location for every purpose. Where a feature shares location with other users, the app should identify the relevant audience or sharing context before or when that sharing is enabled.

You can change device-level location permissions through your operating-system settings, and Takeover may also provide feature-level controls. Disabling location may prevent location-dependent features from working.

5. User Content and Moderation

Takeover may process uploaded photos, videos, posts, comments, messages, reports, and related metadata to operate social features, protect users, investigate reports, and enforce platform rules. Uploaded media or activity may be assessed by automated systems and/or human review for safety, appropriateness, automotive relevance, spam, fraud, abuse, or policy compliance. Moderation systems may make mistakes. Content may be restricted from public feeds, removed, or referred for review under the Terms and Community Guidelines.

6. Sharing and Service Providers

We may disclose personal information:

We do not describe a disclosure as a "sale" or "sharing" merely because those terms are used by a particular U.S. state privacy law. If Takeover engages in processing that applicable law treats as a sale, sharing, or targeted advertising and that law applies to Aria, we will provide any notice and opt-out mechanism required by that law.

7. Retention and Deletion

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected or otherwise lawfully processed, taking into account the nature and sensitivity of the information, the feature involved, security and fraud-prevention needs, legal and accounting requirements, dispute-resolution needs, and applicable law. Location information should not be retained longer than reasonably necessary for the applicable location feature and legitimate security or legal purposes.

Takeover users will be provided a method to request deletion of their account and associated personal information. Some information may be retained for a limited period where reasonably necessary or legally required, including for security, fraud prevention, legal compliance, dispute resolution, backup integrity, or enforcement.

8. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. No system is completely secure, and we cannot guarantee absolute security. Users are responsible for protecting their account credentials and should promptly report suspected unauthorized access.

9. Your Choices and Privacy Rights

Depending on applicable law and where you live, you may have rights concerning your personal information. These may include rights to request access to or confirmation of personal information, correction, deletion, or portability; withdraw consent where consent is the lawful basis for processing; object to or opt out of certain sales, sharing, targeted advertising, or profiling; limit certain uses or disclosures of sensitive personal information; appeal certain privacy-request decisions; and complain to an applicable privacy regulator.

Privacy requests may be sent to awaszak@ariatechnologies.ca. We may need to verify your identity before completing certain requests. Where applicable law allows an authorized agent to submit a request for you, we may require reasonable proof of that authority. We will not unlawfully discriminate against you for exercising applicable privacy rights.

Device-level permissions can also be controlled through your operating-system settings. If applicable law requires a dedicated opt-out mechanism for Takeover's actual processing activities, we will provide that mechanism.

10. Age and Minors

Takeover is currently intended only for users who are at least 18 years old. We do not knowingly offer the adult-only service to children under 13 or knowingly collect personal information from them through that service. If Aria later changes the minimum age, the Privacy Policy, Terms, product controls, age-assurance practices, and consent processes must be reviewed before that change is launched.

11. International and Cross-Border Processing

Aria is a Canadian company. Personal information may be processed or stored in Canada, the United States, or other jurisdictions where Aria or its service providers operate. Privacy and data-protection laws in those jurisdictions may differ from the laws where you live. Information processed in another jurisdiction may be subject to lawful access by courts, law-enforcement agencies, national-security authorities, or other governmental bodies in that jurisdiction.

Where required by applicable law, Aria remains accountable for personal information transferred to service providers for processing and uses contractual, organizational, or other appropriate measures designed to protect it.

12. U.S. State Privacy Notice

If a U.S. state comprehensive privacy law applies to Aria and to your personal information, Takeover will honor the rights that law grants you. Depending on the applicable law, those rights may include access, correction, deletion, portability, opt-out rights relating to sale, sharing, targeted advertising, or certain profiling, and rights relating to sensitive personal information such as precise geolocation.

Not every U.S. state privacy statute applies to every business, and the rights available to you depend on the applicable statute, its thresholds, exemptions, and Takeover's actual processing activities.

13. Changes and Contact

We may update this Policy as Takeover changes. If changes are material, we will provide notice through the app, website, email, or another appropriate method and update the effective or revision date.
